Abstract: This paper examines the emerging complexity of U.S. artificial intelligence regulation, demonstrating how state-level initiatives are driving a de facto national compliance regime despite federal deregulatory efforts. With Illinois enacting the Artificial Intelligence Safety Measures Act (SB 315) to mandate independent third-party audits, it completes a coordinated regulatory triad alongside California’s SB 53 (developer transparency) and New York’s RAISE Act (incident reporting and oversight).
Despite executive branch actions aimed at state preemption, these three major economic powerhouses have established a coherent, complementary framework that closely aligns with the product-safety model of the European Union’s AI Act. Furthermore, federal proposals like the bipartisan "Great American AI Act" seek to elevate this state-level template to the national stage. The paper concludes that through state coordination and potential federalization, the United States is unexpectedly converging toward an EU-style regulatory model that could set a global standard for frontier AI governance.
